Adopt a resolution authorizing exchange of a permanent dumpster easement on a portion of Tax Parcel 097-111-20 and two (2) permanent easements for twelve (12) parking spaces on a portion of Tax Parcel 097-111-47 owned by the County for two (2) areas of fee simple right-of-way use and a temporary construction easement on a portion of Tax Parcel 097-131-16 currently owned by ALPS Holdings, LLC and Paul McNamara (collectively "ALPS")

BACKGROUND/JUSTIFICATION:
At its January 17, 2022 meeting, the Board adopted a resolution declaring its intent to exchange various property rights between the County and ALPS for roadway improvements necessary at the Ella B. Scarborough Community Resource Center ("CRC"). As part of construction at the CRC, the City has required the County to install a right turning lane into the property and a 12' sidewalk along Eastway Drive. To fullfill these requirements, the County is seeking to acquire two areas of right-of-way and a temporary construction easement ("TCE") from ALPS.

In exchange for providing the rights-of-way and the TCE the County must have, ALPS has requested permanent easements for its dumpster and two permanent easement areas for parking spaces for its use. The property rights the County will obtain have a value of $57,721 and the rights desired by ALPS have been valued at $41,808. If approved, the County will compensate ALPS in the sum of $15,913 which is the difference between the value of the ALPS conveyance and the County's conveyance.

Following the January 17th meeting, an advertisement announcing the intent to exchange the property rights was published in the January 24, 2024 edition of the Charlotte Observer. As required by NC G.S. 160A-271, the Board is required to adopt a resolution authorizing the exchange.
