BACKGROUND/JUSTIFICATION:

Property owners have petitioned to abandon a 1.077 acre portion of the right-of-way for Wilbanks Drive.  Per the petition, the portion of the right-of-way petitioned for abandonment and adjacent parcels are to be developed as a residential neighborhood with alternate ingress and egress to be provided prior to the abandonment of said ROW.  NCDOT informed the petitioners on July 14, 2016 that the portion of right-of-way to be abandoned was not State maintained.  General Statute 153A-241 requires a public hearing and approval of the order for closing by the Board of County Commissioners in order to abandon a right-of-way in the unincorporated part of the County.  The attached map shows the current ROW for Wilbanks Drive, the portion petitioned for abandonment, and the proposed replacement ROW for the portion petitioned for abandonment. The proposed replacement ROW is to be built pursuant to the Charlotte Subdivision Ordinance requirements.
