Approve a refund in the amount of sixty thousand dollars ($60,000) to be made by the Finance Department as requested by the Tax Assessor to settle a disputed amount of double taxation under NC GS 105-381 and authorize the County Manager to execute the settlement agreement.

BACKGROUND/JUSTIFICATION:

Tryon Medical Partners, Inc., has made a demand on the County to refund an overpayment of ad valorem taxes for tax years 2019-2024 for business personal property taxes. Tryon Medical Partners, Inc., contends that it overpaid ad valorem taxes by over reporting property improvements made to its business locations associated with personal property. The county denies any liability; however, it acknowledges overpayment to some degree. To avoid protracted litigation, the County and Tryon Medical Partners, Inc., have agreed to resolve the claims and dispute by a reimbursement of sixty thousand dollars ($60,000) for the alleged overpayment. For such payment, Tryon Medical, Inc., agrees to acquit and discharge any claims against the County relating to the overpayment.
