ACTION:
Authorize the County Manager to negotiate and execute a term extension between the County and Charlotte-Mecklenburg Board of Education ("BOE") for that certain agreement dated December 4, 2007 titled "CMGC 5th Floor Lease" between the County and BOE for office space located in the Charlotte-Mecklenburg Government Center ("CMGC")

BACKGROUND/JUSTIFICATION:
Through the 1990 Charlotte-Mecklenburg Government Center contract, the County had use of half of the 5th floor of CMGC with City Human Resources occupying the other half of the floor. The County entered into a lease arrangement with the City of Charlotte in 2007 in which the City leased to the County its one-half portion of the 5th floor upon the County renovating the then Criminal Courts Building (now the Judge Johnson Building) for the relocation of both City and County Human Resources Departments. In 2007, the County in turn did an arrangement with BOE in which CMS would lease the entirety of the 5th floor of CMGC (i.e., a lease of the County's one-half share and a sub-lease of the City's one-half share).
The lease between the County and CMS has a term period of twenty (20) years, beginning from July 1, 2009. CMS has planned some upgrades to the floor such as new carpeting, finishes, and minor room reconfigurations and would like to extend its lease to December 6, 2032 to coincide with the termination date of the County's lease with the City for the City's one-half portion of the space. The County's Asset and Facility Management Department has evaluated this request and has determined that the County does not have a need for the space during this period. Except for extending the lease to December 6, 2032, all other terms and conditions of the lease will remain the same.
