ACTION:

Authorize the County Manager to negotiate and execute an amendment to the Condominium Association Declaration allowing the County to place a permanently new generator for the use of Board of Elections (“BOE”)  located at  in having Tax Parcel  (125-203-05)

BACKGROUND/JUSTIFICATION:

741 Kenilworth Ave LLC is the owner of the condominium building located at 741 Kenilworth Ave, Charlotte, NC. The building contains multiple individually owned condominiums units that operate under the property’s Condominium Association Declaration along with the Covenants, Conditions and Restrictions. ("CC&Rs").  Mecklenburg County currently owns Units 200, 202 and 300 within the building and operates county services from those spaces.

The Unit owners of Units 100,102, and 204 along with Mecklenburg County as owner of Units 200, 202 and 300, have unanimously agreed to amend the Declaration of Condominium and related parking arrangements within the property. The purpose of the amendment is to relocate designated parking spaces in order to accommodate the installation of a permanent standby generator adjacent to Unit 202.

The proposed 250KW backup power system is necessary to support continuous operations for the BOE office located in Unit 202 during an emergency or power outages. All participating unit owners have reviewed and agreed to the proposed changes to facilitate the installation and ongoing of the generator.
