Amendment to a Dock Lease with Duke Energy and a New Dock Lease with the City of Charlotte - CMPD Boathouse at McDowell Nature Preserve

ACTION:
1) Authorize the County Manager to negotiate and execute an amendment to the Nature Preserve Public Recreational Facility Lease, effective March 27, 2024, between the County and Duke Energy Carolina, LLC (“Duke Energy”) for docks located on County-owned Tax Parcel 199-311-01 at McDowell Nature Preserve to remove one (1) of the five (5) dock areas from the subject Lease; and
2) Authorize the County Manager to negotiate and execute a lease and any other documents deemed necessary between the County and the City of Charlotte (on behalf of Charlotte-Mecklenburg Police Department) to construct, operate and maintain a reconstructed boathouse for law enforcement operations along Lake Wylie.

BACKGROUND/JUSTIFICATION:
At its March 5, 2025, meeting (Item #25-0125), the Board of County Commissioneres authorized 1) an amendment to the March 27, 2024, Lease between the County and Duke Energy at McDowell Nature Preserve to allow for the reconstruction, operation, and maintenance of the CMPD boathouse on “Lease Area 1” of the subject Lease and 2) a subsequent sublease with the City for Charlotte-Mecklenburg Police Department's (CMPD’s) use and maintenance of the boathouse. Since then, Duke Energy has confirmed that the Federal Energy Regulatory Commission (FERC) agreed to remove Lease Area 1 from its licensing requirement which means that the area needed by the City for the boathouse is no longer required to be part of the lease between the County and Duke Energy.
Based on FERC’s removal of licensing requirements, the existing lease between the County and Duke Energy will need to be modified to remove Lease Area 1, the location of the boathouse. Once the lease between the County and Duke Energy is amended, the County will ...
