ACTION:
1) Accept donation of a portion of Tax Parcel 051-081-27 (+/- 1.82 acres) for future Mallard Creek Greenway;
2) Accept donation of an Access Easement (size to be determined upon survey) from the City of Charlotte on a portion of Tax Parcel 051-081-27 upon transfer of fee simple ownership of the subject property from CND-VP Brightside, LLC to the City of Charlotte to access future greenway along Mallard Creek

BACKGROUND/JUSTIFICATION:
On September 3rd, 2025 the Board of County Commissioners approved acceptance of +/- 10.18 acres per approved rezoning, 2024-829. The subject property owner, CND-VP Brightside, LLC has proposed to donate an additional +/- 1.82 acres of Tax Parcel 051-081-27 for future Mallard Creek Greenway in the City of Charlotte’s Extraterritorial Jurisdiction. The land is located adjacent to Mecklenburg County’s eastern boundary line, just south of N. Tryon Street with both multi-family and single-family communities surrounding it. The land is vacant and mostly treed with a few open fields, along with Mallard Creek along the southern property line.
The donation given by CND-VP Brightside, LLC will allow the County to construct an expansion of the future greenway in this area and provide access for the residents in the new Brightside multi-family residential development.
To access the previously donated greenway property (accepted at the September 3rd 2025 BOCC meeting), the County will be granted an Access Easement from the City of Charlotte over another adjacent area of the parent tax parcel that is planned for donation to the City by the developer. The exact size of the access easement will be determined at a later date upon completion of a survey.
The donation is consistent with Park and Recreation’s Greenway Master Plan that calls for the addition of parkland, greenway and open space...
