Revisions to the Mecklenburg County Air Pollution Control Ordinance (MCAPCO)
Action
ACTION:
(1) Receive information regarding proposed revisions to the MCAPCO to incorporate a financial model for adjusting permitting and compliance fees.
(2) Approve opening a public review and comment period beginning April 16, 2024, for the proposed revisions and,
(3) Schedule a public hearing on May 23, 2024, no earlier than 6:30pm to receive public comments.

BACKGROUND/JUSTIFICATION:
Mecklenburg County Air Quality is proposing a model for the annual adjustment of permitting fees for regulated sources of air pollution. Information will be presented regarding the proposed fee model.
Incorporation of this model, requires a revision to the Mecklenburg County Air Pollution Ordinance which must be preceded by a 30 day public comment period. The proposed revisions involve adjustments to permitting and compliance monitoring fees currently found in MCAPCO Regulation 1.5231 - “Air Quality Fees.”
The model, fee adjustments and ordinance change will be included in the overall FY25 budget ordinance.

Revised fees provide the minimum funding necessary to sustain industrial source permitting, inspections, and ambient air monitoring by the Air Quality Division.
FISCAL IMPACT:
FY 25 Air Quality fees increase will result in approximately $73,772 in additional revenue.
