ACTION:
1) Amend and restate the Mecklenburg County "Criminal History and Motor Vehicle Records Checks" Ordinance to bring into alignment with NCGS 153A-94.2
2) Revise the Human Resource Policy Manual to authorize the Human Resources ("HR") Department to adopt HR policies to operationalize and execute the newly amended Ordinance provisions as required by law and practice.

BACKGROUND/JUSTIFICATION:
In 1999, the Board of County Commissioners ("Board") adopted an Ordinance related to criminal history and motor vehicle record checks that was incorporated in the Board's section of the Mecklenburg County Human Resource Policy Manual. The North Carolina General Assembly recently revised the applicable statute, NCGS 153A-94.2, which has made specific changes applicable to the Ordinance. HR recommends amending the current Ordinance to bring it into alignment with NCGS 153A-94.2. It is necessary to revise the current Ordinance to reflect the legislative changes pursuant to the statutory language. The proposed updates are also intended to preserve the spirit of the Ordinance but to make it evergreen to the extent allowed by law. However, it is also more practical for the policy supporting the Ordinance, which is designed to implement the changes, to be placed under HR policy to better operationalize the practice and future compliance with the law.
