ACTION:
A) Authorize the County Manager to file a Right-of-Way Abandonment petition with the Charlotte Department of Transportation (CDOT) requesting closure of +/- 0.43 (18,666 1sq. ft.) acres of Barlowe Road right-of-way

B) Upon approval of the above petition by CDOT, accept ownership of the residual +/- 0.32 (14,140 sq. ft.) acres vested to the adjacent County parcels

BACKGROUND/JUSTIFICATION:
The County intends to construct a stream restoration and water quality enhancement project. The funding for this project is from the Mecklenburg County Storm Water Capital Improvement Program (CIP) and a North Carolina Land and Water Fund grant. Before construction can take place, rights-of-way must be abandoned and closed. The County is requesting closure of Barlowe Road by the Charlotte Department of Transportation (CDOT) from the intersection of Barlowe Road and Dewolf Street to the end of Barlowe Road. As the current property owner of adjacent parcels, Mecklenburg County must petition the City to close a +/- 0.43-acre portion of the public right-of-way for Barlowe Road. The portion of said right-of-way currently dead ends to the I-85 NCDOT ROW with no public access. This will allow the County to construct water quality improvements in the former roadway. The permanent closure of City of Charlotte streets requires filing a Right-of-Way Abandonment petition with CDOT. Once a request to abandon right-of-way is granted, the area that has been abandoned is divided, with owners on either side receiving an equal share of the property. The County owns all the existing parcels along the abandoned road except for one privately held parcel. This property owner supports the closure and has agreed to sign the petition as well.
