ACTION:

1) Set a public hearing for September 16, 2025, to hear comments from the public and vote on whether to authorize organization of a MPTA.

 

2) Direct the Clerk to the Board to give notice of the public hearing not less than ten days before the scheduled hearing date, which notice shall contain a brief statement of the substance of the proposed resolution, shall set forth the proposed Articles of Incorporation of the Authority, and shall state the time and place the public hearing to be held thereof.

BACKGROUND/JUSTIFICATION:

The Board of County Commissioners held a public hearing on August 6, 2025 and voted to direct the director of the Mecklenburg County Board of Elections to  add an advisory referendum question to the November 4, 2025 ballot on whether to approve an additional one percent (1%) local sales and use tax, in addition to the current local sales and use taxes, to be used only for roadway systems and public transportation systems. If the referendum is approved by the voters, the County may not levy the local sales and use tax under the PAVE Act until it has established a Metropolitan Public Transportation Authority. Further, the PAVE Act requires that certain actions be taken by the MPTA by January 1st, 2026. The legislation authorizes the Board of Commissioners to adopt a resolution signifying its determination to organize an authority under the provisions of the PAVE Act. The resolution shall be adopted after a public hearing thereon, notice of which shall be given by publication at least once, not less than 10 days prior to the date fixed for such hearing.
