ACTION:
1) Authorize the County Manager to negotiate and execute all documents necessary for acquisition of a Permanent Greenway Easement (+/- 1.064 acres) over a portion of Tax Parcels 005-142-26, 005-142-25, and 005-142-11 from Charlotte-Mecklenburg Board of Education for construction of a portion of the McDowell Creek East Greenway
2) Authorize the County Manager to negotiate and execute all documents necessary for acquisition of a Temporary Construction Easement (+/- 0.253 acres) over a portion of Tax Parcels 005-142-26, 005-142-25, and 005-142-11 from Charlotte-Mecklenburg Board of Education for construction of a portion of the McDowell Creek East Greenway

BACKGROUND/JUSTIFICATION:
McDowell Creek East Greenway is a part of Park and Recreation’s current Capital Improvement Plan. The proposed greenway will extend from Catawba Avenue at Smithville Park to Westmoreland Road at JV Washam Elementary in Cornelius. The project includes approximately 1.6 miles of greenway trail and 0.7 miles of multi-use path through residential and commercial areas. The greenway will provide residents with an alternative transportation route and improved access to nearby parks, schools, businesses and other community amenities.
The remaining portion of the McDowell Creek Greenway has been completed and provides access to Birkdale Village in Huntersville as well as Robbins Park, the Westmoreland Athletic Complex and Magnolia Estates Drive in Cornelius.
To construct this greenway project, which has a County-funded budget of $14,149,445, the County needs to acquire a Permanent Greenway Easement (PGE) and Temporary Construction Easement (TCE) on the above referenced parcels.
