ACTION:

Authorize the County Manager to grant a Temporary Construction Easement of approximately ± 0.1234 acres or 5,375 square feet to Steele Creek Owner, LLC on Mecklenburg County owned tax parcel 219-124-22 for the construction of a retaining wall.

BACKGROUND/JUSTIFICATION:

At its June 17, 2025, meeting, the Board approved to accept a donation of ± 1.6101 acres of land on a portion of tax parcels 219-121-14 and 219-124-01 from Christ the King Lutheran Church for future Hoover Creek Greenway and for a new residential community development as a rezoning requirement by petition 2023-164.

 

Steele Creek Owner, LLC (“Steele”) is developing a 187-unit townhome residential community. Steele is planning to construct a retaining wall to serve the development. Steele is requesting ± 0.1234 acres or 5,375 square feet of Temporary Construction Easement (TCE) to access a portion of Mecklenburg County property (tax parcel 219-124-22) located along Hoover Creek Greenway at the undeveloped Generations Street Park to complete grading activities associated with this work.

 

The TCE will commence upon the effective date of the Agreement and will expire in twelve (12) months. Steele will be responsible for restoring the TCE area to the same or improved condition. Steele inadvertently proceeded with donating parcels to the County instead of customarily holding the parcels to use for staging during construction. The value of the two (2) parcels the County received exceeds the value of the TCE area, therefore, the County will not receive cash compensation.

 

The request has been reviewed by the Park and Recreation Department and it has been determined that the request will not negatively impact the park property.
