Access Easement, Road Maintenance Agreement and Temporary Construction Easement - Thayer Road Park

ACTION:
1. Authorize the County Manager to negotiate and execute a Road Maintenance Agreement and Access Easement with Digital Moores Chapel, LLC on Mecklenburg County owned Tax Parcel 053-221-06 (Thayer Road Park) for future Lakebrook Road Extension.
2. Authorize the County Manager to grant a Temporary Construction Easement (+/- 2.141 acres) to Digital Moores Chapel, LLC on Mecklenburg County owned Tax Parcel 053-221-06 (Thayer Road Park) for the construction of Lakebrook Road Extension.

BACKGROUND/JUSTIFICATION:
In FY25 the County received a large parkland donation (+/- 54.67 acres) in west Charlotte which is now called Thayer Road Park. The deed for the land the County received included a reservation of road right-of-way for the extension of Lakebrook Road. The road extension will go from its current terminus along the property the County received to Tax Parcel 053-161-01 which is owned by the donor of the land and is immediately east of the County’s property. The donor is now ready to construct the reserved right-of-way which will provide access to their future commercial development.
Since Lakebrook Road Extension will be a private road (i.e. not publicly maintained by either CDOT or NCDOT) and is also the County’s access point for Thayer Park, the County is requiring the Access Easement and Road Maintenance Agreement be finalized before construction begins. The Road Maintenance Agreement will require the developer to take full responsibility for the maintenance of the future road and the Access Easement will allow the County and public full access over the road.
In addition to the two Agreements, the developer will need to obtain a Temporary Construction Easement (+/- 2.141 acres) from County to construct the road. The request has been reviewed by the Park and Recreation Department and it has been determined that the request will not negatively impact the park property.
