Terms for the Alcoholic Beverage Control (ABC) Board

ACTION:
Approve the following staggered term adjustments for the current members of the ABC Board to be in compliance with NCGS 18B-700(a)
Marcus Kimbrough, appointed March 7, 2023, first term to expire June 30, 2026 (extend first term one year to expire June 30, 2027)
Jerry Neal and Wilhelmenia Rembert, appointed March 7, 2023, first term to expire June 30, 2026 (extend first term two years to expire June 30, 2028)
Beverly Thorpe, appointed March 7, 2023, first term to expire June 30, 2026 (extend term first term three years to expire June 30, 2029)
Monifa Drayton, first term to expire June 30, 2024 (no recommendation for extension) but eligible for reappointment.

BACKGROUND/JUSTIFICATION:
NCGS 18B-700(a) states in pertinent parts that appointments to the ABC board shall consist of three or five members appointed for three-year terms. Terms are to be staggered and if the board is a five-member board, one member of the initial board of a newly created ABC system shall be appointed for a three-year term, two members for two-year terms, and two members for one-year terms. As the terms of initial board members expire, their successors shall each be appointed for three-year terms. The appointing authority shall designate one member of the local board as chairman. During COVID-19, the Board approved term extensions to maintain continuity of operations, and that, coupled with ABC board resignations caused the terms to no longer be staggered. The BOCC appointment policy states that individual appointees may serve two full terms on any appointed board including after having been appointed and served out a previously held unexpired term. To bring the current appointee’s terms into compliance with the staggered term arrangement required by statute, the above revisions are recommended.
