Authorize the County Manager to Negotiate and Execute a Sublease of Property to the Family Services of America Corporation.

BACKGROUND/JUSTIFICATION:
On June 2, 2024, the County entered into a lease agreement with Star Mountain West, LLC to lease the facility located at 4016 and 4024 Triangle Drive, Charlotte NC, and having tax parcel number 065-032-07. The lease terms required the Landlord to renovate the building to house an Emergency Youth Placement Facility for the County, and the County to reimburse the Landlord for the total cost of construction.
Following execution of the lease, on July 1, 2024, the County and the Department of Child, Family, and Adult Services (CFAS) solicited proposals for operation of the Emergency Youth Placement program in the Star Mountain facility, and the Family Services of America Corporation (FSAC), an entity incorporated in North Carolina, was selected as the best provider. The County must execute a sub-lease with FSAC to use the facility and operate the Emergency Youth Placement Facility.
The County Manager will negotiate a sublease agreement consistent with the following business terms:
Location: 4016 and 4024 Triangle Drive, Charlotte, NC 28208
Lease Area: 4,926 Square Feet
Base Rent: $1 per year
Sublease Term: Initial Term - From execution of the lease to January 31,
2028
Renewal - Two (2) years
Utilities: The County shall be responsible for the payment of
electricity, gas, water, sewer and other utilities needed at the
premises.
Parking: FSAC and its employees, guests, and invitees shall be
entitled to park on the land at 4016 and 4024 Triangle Drive and on
the adjacent land at 4010 Triangle Drive on a first-come first-serve
basis with the exception of those certain spaces identified by the
Landlord as for the sole use of the Landlord.
Maintenance
and Repairs: County is responsible for all repairs, janitorial, and
maintenance of the Premises, including major (capital)
repairs.
Insurance: FSAC shall be required to maintain personal property
and contents insurance coverage and any other insurance
coverages required under the operating agreement with the
County.
