BACKGROUND/JUSTIFICATION:
The subject property owner TPG AG EHC III (EMP) Multi state 2, LLC, has proposed donating Tax Parcel 037-071-52 (+/- 10.335 acres) to the County for addition to Possum Walk Nature Preserve as part of a “by-right” approval process for the Windsford Subdivison. The nature preserve is located off of Miranda Road and is situated west of I-77 and inside the I-485 inner loop. The subject parcel is heavily wooded with the northern boundary abutting the existing nature preserve and the eastern and southern boundaries running along McIntyre Creek. The property is within close proximity to several residential neighborhoods including, the Woodlands subdivision.
The Windsford is being planned for construction on Tax Parcel 037-081-05 (+/- 27.36 acres) which shares a boundary with the County’s nature preserve. To facilitate construction of the subdivision, the owner has requested to make a tie-in to the existing sanitary sewer easement that is located on the County’s nature preserve property. The developer is asking for a permanent sewer easement (+/- 0.41 acres) and temporary construction easement (+/- 0.114 acres) for sewer over County owned Tax Parcel 037-081-102.
Staff with Park and Recreation’s Nature Preserve and Natural Resources Division has reviewed the easement request and found that it does not pose a threat the health and continued operation of the nature preserve. The department believes that the addition of Tax Parcel 037-071-52 will serve to benefit the nature preserve and the public in several important ways including providing additional water quality protection, added buffer protection for the nature preserve, and greenway connectivity along the creek.
The donation is consistent with Park and Recreation’s Greenway Master Plan that calls for the addition of parkland, greenway and open space within the County. It is also consistent with the County’s Environmental Leadership Action Plan.
The requested permanent sewer easement will be conveyed to the City of Charlotte under the County Manager’s authority. A separate temporary construction easement will be conveyed to the owner (and/or assignee) to allow for construction of the sewer tie-in. Following completion of the sewer project, the sewer will be maintained by the City of Charlotte. The land being conveyed to the County has a tax value of $180,600. The appraised value of the temporary construction easement being granted to the developer is $1,050.
